MURMUR’s (“we”, “us”, “our”) website (“our site”) www.murmurstore.com and related services are made available to you in accordance with the below Terms & Conditions. Please make sure you read and fully understand our Terms & Conditions before placing any orders with MURMUR. If you are using a guardian’s credit or debit card to make a purchase you must let your guardian know about our Terms & Conditions and Privacy Policy before subscribing and/or signing up to our site.

Personal Information

To make a purchase on our website you are not required to register. You can proceed to checkout, as a visitor should you not wish to open an account. To be able to use some of the services and features you will need to create an account with us. To be notified of any promotional offers, discounts and/or special events, you will need to subscribe to our newsletter. You do not need to create an account to subscribe to our newsletter, but can opt to do so once you have created an account and have signed in. When you register, you are required to provide information about yourself that is true, accurate, current and complete in all respects. The account password you provide should be unique and kept secure. You must notify eshop@murmur.ro immediately of any breaches in security or unauthorized use of your account.

ORDER

Acceptance
Once you have made your choice and your order has been placed, you will receive an e-mail acknowledging the details of your order. This e-mail is NOT an acceptance of your order, just an acknowledgement that we have received it. Unless you cancel your order, acceptance of your order and completion of the contract between you and MURMUR will be completed when we e-mail you to confirm the goods have been dispatched.

We reserve the right not to accept your order in the event that we do not obtain authorization for payment; that shipping restrictions apply to a particular item; or that the item ordered is out of stock.

We may refuse to process and therefore accept a transaction for any reason, or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from the website at any time, whether or not that particular product has been sold out.

Eligibility 
In order to make purchases through the website, you are required to provide your personal details. Customers must provide their real name, billing address, shipping address, phone number, e-mail address and other requested information as indicated. Furthermore, when ordering items, you will be required to provide your payment details, and you represent and warrant that the payment details you provide on ordering are both valid and correct. Our site is only available for use to individuals who meet our terms of eligibility and who have been issued with a valid debit/credit card by a bank acceptable to MURMUR and whose applications are acceptable to MURMUR.

Pricing Policy

The prices are indicated in LEI including VAT.
Please note that your order may be subject to import duties and taxes over which we have no control as they are levied by your tax and customs office. As the customer and importer of the goods, you will be responsible for these charges. Import duties or tax costs will be invoiced to you directly from the appointed forwarder. We recommend you contact your local customs authority to determine a landed cost price prior to purchase completion. MURMUR is not responsible for any delays on goods that have been held back as a result of procedures carried out by your local customs authorities.

On MURMUR’s website there is a feature of viewing prices in EUR and USD via the currency converter tab within the shop section of the website. The currency converter is directly linked to the XE and rates used are in real time, however the product prices in currencies other than in LEI are only indicative. The rates used will vary and depend on the spot rates applied by your credit card/account provider.

MURMUR will not offer a price adjustment on items originally purchased in a sale or any other promotion that are temporarily reduced in price. Once an item has been purchased at a discounted price or sale, no price adjustment will be offered should a further sale or price reduction follow.

Payment

By card
Payment can be made by Visa and Mastercard cards, and via Paypal. Debit and credit card payments are processed via MobilPay, a 3D-secure payment gateway provider. If you own a card issued by Credit Europe Bank, Banca Transilvania, Garanti Bank, Alpha Bank, BRD Finance, you can now pay in 2, 3 or 4 installments through Mobilpay using 3D Secure. For more information on Mobil Pay, please refer to https://www.mobilpay.ro. PayPal is an online payment processing company widely used on the Internet to facilitate sales transactions, including credit card payments. When you proceed with making your online purchase and you select PayPal as a method of payment you will be transferred to the PayPal site where your transaction will be processed. You do not need a PayPal account and there is no additional cost to you. For more information about PayPal, please access www.paypal.com.

Payment will be debited and cleared from your account upon receipt of an order acknowledgement email. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. All credit/debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to MURMUR, we will not be liable for any delay or non-delivery.

Furthermore, we take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Site.

By Cash on Delivery
Payment in Cash are only available in Romania and are processed by FanCourier.

By Klarna

In order to offer you Klarna’s payment methods, we might in the checkout pass your personal data in the form of contact and order details to Klarna, in order for Klarna to assess whether you qualify for their payment methods and to tailor those payment methods for you. Your personal data transferred is processed in line with Klarna’s own privacy notice.

Promotion codes & credit notes
Promotion codes are non-transferable and there are no cash alternatives. If provided, they must be redeemed by the date published. Promotion codes do not apply for items that are already discounted. Credit notes are non-cash transferable and must also be used within the allocated period either by emailing eshop@murmur.ro.

Gift Cards
MURMUR Virtual Gift Cards are sold subject to the following terms and conditions:
Gift Cards are valid six months from the date of purchase.
Gift Cards can be redeemed against all products on the the murmurstore.com.
Gift Cards are non-transferable, can only be used on the MURMUR site for which they are issued and may not be returned or redeemed for cash.
If you return products you have purchased using a Gift Card, the remaining balance will be credited and will be redeemed against subsequent orders.
Virtual Gift Cards will be e-mailed to the recipient once the full order has been processed and payment has been taken. A copy will also be sent to the sender as confirmation of dispatch.

MURMUR is not liable for delivery of a Virtual Gift Card to an incorrect or non-existent email address. This is the sole responsibility of the purchaser.
MURMUR is not responsible if a Gift Card is lost, stolen, destroyed or used without permission.
MURMUR reserves the right to cancel a Gift Card if we deem such action necessary.
Sales tax and shipping is applicable on any products purchased with a Murmur Gift Card.
Gift Cards can be purchase only with Debit/Credit Card or PayPal.

Delivery

MURMUR will dispatch your order within 24 hours of receipt of payment details – excluding weekends, bank holidays and public holidays. This is subject to credit clearance and availability of stock. If a particular product is not in stock we can make it exclusively for you. Please contact us on eshop@murmur.ro for more information.

To offer you the most secure and efficient service we have chosen FanCourier for Romania deliveries free of charge. We use DHL for international deliveries, in this case shipping costs are supported by you. The shipping cost vary upon shipping country and number of items ordered.  As soon as your order has been shipped you will receive a dispatch confirmation with the tracking number from us, together with details on how to track your order. Please note that these services might not be available during the festive and pre-festive days. Also note that the estimated delivery times are to be used as a guide only, and MURMUR is not responsible for any delays caused by destination customs clearance processes.

MURMUR insures each purchase for the time it is in transit only. A signature is required for any goods delivered, at which point responsibility for your purchased goods is passed to you.

 

Returns Policy

We want our customers to be fully satisfied with the choice they have made. If for any reason you are not happy with your order, the size is not suitable, or the delivered product does not match with your specifications, or you find a manufacturing defect, you have the right to return your order.

We accept returns within 14 days, starting from the day your order has arrived at the delivery address.

Return items not accompanied by a filled out Return Form will not be accepted. The printed Return Form is provided by us within any package.

Returned items must comply with our returns policy:

  • Items must be returned unworn, undamaged, unwashed and unused, with all tags attached and the original packaging included
  • Footwear must be returned with the original branded boxes. When trying on footwear, please do not mark the soles or damage the shoe box
  • Final sale items cannot be returned unless the item arrives damaged or faulty when delivered to you
  • Lingerie/bodysuits must only be tried on over your own undergarments. We will not accept any returns that have been worn or are soiled
  • Made-to-order items cannot be returned as they have been created to your specification, unless the item arrives damaged or faulty when delivered to you. We can only proceed with further necessary alterations.

All the international shipping costs of the return must be supported by the customer.

For a faster and safer international return, we strongly recommend you to use the shipping company we work with: DHL Express or UPS. Anyhow, you can also use another registered international delivery company (not post services) for the return and provide us all shipping details through email at eshop@murmur.ro.

For an easier return process, we can arrange a delivery pick-up at your place with our delivery company. Write us an email with all the pick-up details and we can generate a payment link for the delivery costs and provide you the shipping label that you must print and attach to the parcel.

In case of dispute, we strongly recommend you retain proof of return, such as a consignment note.

We do monitor the number of returns made by customers and more than 3 unjustified returns in breach of our terms and conditions will be flagged and may, at our discretion, lead to the closure of future orders being refused.
MURMUR will contact you within 5 days (with the exception of weekends and public holidays) of receipt of the returned goods.

REFUNDS

Once your return has been received by our brand, it can take up to 5 working days to process.
When your return has been accepted subject to the returned goods meeting the conditions listed in the paragraphs above, your refund will be processed to your original payment method, excluding any delivery costs or taxes/import duties. Refunds can take up to 14 days to show in your account, depending on your payment provider.
If you have paid via Paypal, any transactional charges that might apply will not be refunded as these charges are levied by Paypal and not MURMUR.

EXCHANGES & CREDIT NOTES

If you wish to exchange your order for a different size and/or product(s) or be issued with a credit note, please contact eshop@murmur.ro within 14 days of receipt of your order and send the package back to us. Moreover, you must fill in the Return Form enclosed with your order and return it together with the order. Exchanges are subject to stock availability. We recommend you to contact us as soon as you decide to change the size/product/color, so we can put on hold the desired item until the return comes back to us.

The Credit Note contains only the amount of the products, excluding any delivery or taxes costs. You can use the Credit Note for any future orders placed on our website. Fulfill the Return Form specifying the desire to proceed with a credit note, and after we process the return, we create a Personalized code you can use at checkouts. We will inform you as soon as the Personalized Code will be created.

Privacy policy

You consent to our Privacy Policy by making an online purchase, creating an account and/or subscribing to our newsletter.

By making an online purchase; you are granting consent to us retaining some personal data which you provide us with. Such as your name, e-mail address, telephone numbers and addresses in order to process and deliver any orders you place. By placing an order with us you consent to your card/bank details being shared with our secure payment partners Mobil Pay and Paypal so that your payment transaction is processed. Similarly you consent to your telephone number, email address and shipping address being shared with our nominated couriers (FanCourier, DPD and/or UPS) and distribution facilities for fast track and/or international deliveries so that your order can be delivered, and you can be contacted by telephone on any matter regarding the status of your order(s). We accept no liability on behalf of our payment partners, couriers or distribution facilities.

By creating a MURMUR account; you are granting consent to us retaining some personal data, which you provide us with. Such as your name, e-mail address, telephone numbers and addresses in order to process and deliver any orders you place

By subscribing to our newsletter; you are granting consent to us retaining some personal data which you provide us with, such as your name, e-mail address, location, date of birth and gender in order to keep you informed via newsletters and e-mails. We will never share your personal data with third parties without your consent. When you subscribe to our newsletter you are agreeing to us contacting you via e-mail with details on new products, collections, features, sample sales, special offers, contests, events of interest and promotions.

At all times, we will offer you the opportunity to unsubscribe out of any service or update to which you have subscribed, if you change your mind. Any e-mail we send you will contain an easy automated unsubscribe link so that you can opt-out of that particular service.

We collect information about site traffic, sales, wish lists and other commercial information which may be shared with our third party advertising platform in order to enhance your shopping experience.

Finally, we may use your personal information for our internal marketing and demographic studies, together with non-personal data to monitor customer patterns so that we can consistently improve our site design to better meet our visitors’ needs.

MURMUR do not advertise other brands/labels/organizations on our website, and therefore we do not have third party cookies.

Opening an account/ Subscribing to our newsletter
When you open an account, you will be given the option to subscribe to our newsletter or to opt out of this service. By subscribing to our newsletter you agree to receive email alerts for new products, collections, features, sample sales, special offers, contests, events of interest, and promotions.

At all times, we will offer you the opportunity to unsubscribe out of any service or update to which you have subscribed, if you change your mind. Any e-mail we send you will contain an easy automated unsubscribe link so that you can opt-out of that particular service.

Accessing, editing and deleting your personal data
If you need to update/edit your personal information, please visit the website and after logging into your account using the “Sign In” tab on the top right corner of the home page, your personal information will be made available for review and change. You can also change, save or delete billing/delivery addresses. If you change your billing or shipping address while your order is still being processed, the order will be re-processed through security validation checks. If you prefer, you may contact us by email at eshop@murmur.ro and we will amend your personal details. In line with GDPR regulations in place as of 25th May 2018, you have the right to delete any information from your account at any time. You can do this by logging into your account and deleting the contact details you keep on file. In order to fully close your account, please contact eshop@murmur.ro. Please note that the right to be forgotten is only applicable to customers with no transaction history and we are unable to fully delete any past transactions and/or contact details associated with the transaction from our system.
